BOOKING AGREEMENT - TERMS AND CONDITIONS

1. The booking agreement is concluded as soon as the apartment has been booked by the guest and the booking confirmed. In the case of a provisional booking, the guest must confirm the booking once availability has been offered.

2. The guest is required to pay a deposit of 30 per cent of the rental fee within 7 working days after the booking has been confirmed.

3. The rental fee must be paid immediately and in full when the keys are handed over.

4. A cleaning fee of 19 euros is to be paid in advance along with the rental fee.

5. On the day of arrival the keys may be handed over at the apartment from 15.00 hrs. On the day of departure, the apartment must be vacated by 11.00 hrs. Different times by prior arrangement only. Where no prior arrangement has been made, the keys will be handed over at the apartment. Loss of keys will incur a charge of 35 euros.

6. The apartment may only be occupied by the number of guests confirmed on the booking agreement. Any infringement of this agreement will incur an additional fee from each additional guest of 25 euros per night.

7. If the guest does not use the apartment for the period booked and confirmed, the guest is committed to pay the following costs to the landlord:
• cancellation up to 3 months
before the agreed start of the
tenancy: 0 Euro
• cancellation up to 6 weeks before
the agreed start of the tenancy,
50 per cent of the agreed rental
fee
• In the case of a later cancellation,
100 per cent of the agreed rental
fee is due.

8. In the case of an early departure, the payments already made for the remaining period cannot be reimbursed.

9. If the landlord does not make the apartment available to the tenant for the agreed period, the landlord is obliged to reimburse any rental fees already paid. In addition, and upon written request by the tenant, the landlord is obliged to pay the following additional damages:
• cancellation up to 3 months
before the agreed start of the
tenancy: 0 euros
• cancellation up to 2 months
before the agreed start of the
tenancy: 20 euros for each night
booked, up to a maximum sum of
200 euros.
• in the case of a later cancellation,
30 euros for each night booked up
to a maximum sum of 500 euros.

10. The guest and landlord expressly waive any further claims from the contract.

11. The guest is obliged to treat the apartment and its contents with due care and attention and is obliged to observe the no smoking rule in those apartments designated as non-smoking.

12. The guest is required to leave the apartment in good order and is fully liable for any damages he causes to the apartment during his tenancy.

13. The landlord cannot be held responsible for any temporary breakdown of equipment, public energy or water sujpplies, etc. A price reduction cannot be made under such circumstances. This also applies to force majeure events.

14. The landlord reserves the right to alter the furnishings/equipment in the apartment.

15. The landlord is entitled to enter the apartment if necessary. The landlord is not responsible for any of the guests` valuables. Use of the apartment stairs, equipment, etc. is at the tenant`s own risk.

16. Owing to damages caused in the past, pets are unfortunately not allowed in the apartments.

17. The guest is under obligation to respect the general customs that relate to living in apartment buildings and must avoid causing any noise likely to disturb other tenants. Failure to observe this rule will lead to the termination of the booking contract. Under such circumstances, no compensation can be made for the curtailment of the tenant`s stay.

18. Both parties are obliged to fulfil the contract.

19. If any sections of the above terms and conditions should be incorrectly worded or invalid, any such section, shall, in the case of any dispute, be replaced by a construction appropriate to the sense and purpose of this agreement.

20. Exclusive place of jurisdiction is Berlin

21. If the landlord does not make the apartment available to the tenant for the agreed period, the landlord is obliged to reimburse any rental fees already paid
